CareCompass is a software service operated by Mindful Me, LLC. These policies are the current published version. Questions? Contact andrea@andreagoundrycounseling.com.
These Terms of Service (the “Terms”) govern your access to and use of CareCompass, a software service operated by Mindful Me, LLC. In these Terms, “Mindful Me, LLC,” “CareCompass,” “we,” “us,” and “our” refer to Mindful Me, LLC. By creating an account or using CareCompass, you agree to these Terms.
1. Eligibility and clinician accounts
CareCompass is intended for approved clinicians and authorized members of an approved clinical practice. To create or use an account, you must:
- be at least 18 years old;
- have the legal capacity to enter a binding agreement under the law of your jurisdiction;
- be an approved clinician, or an authorized member of an approved clinical practice acting within the scope of that authorization;
- provide accurate professional and licensing information, including your legal name, professional credentials, and license information, and keep it current; and
- hold, in good standing, any professional license, registration, or authorization that you claim to possess.
Not every authorized practice member is required to independently hold the same license as the supervising clinician; each user is responsible only for the credentials that user represents to hold. We may verify licensing information provided at application or at any later time. Your account is personal to you and may not be shared.
2. Account security and multi-factor authentication
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must enable multi-factor authentication (MFA) when we make it available or require it, and you must promptly notify us at andrea@andreagoundrycounseling.com if you suspect unauthorized use of your account.
3. Appropriate and prohibited use
You agree not to:
- use CareCompass for anything other than your legitimate clinical practice;
- upload content you do not have the right to upload;
- enter protected health information (PHI) or client-identifying information during the current clinician beta, including inside prompts sent to any AI-assisted feature (see the HIPAA & Health-Data Notice);
- attempt to gain unauthorized access to any part of CareCompass, other users’ data, or our infrastructure;
- reverse engineer, scrape, or interfere with the normal operation of the service;
- use CareCompass to harass, defame, or harm any person; or
- use CareCompass in a way that violates applicable law or professional ethics rules.
4. Authorization, consent, and clinician responsibility
You are solely responsible for obtaining any authorizations, consents, or releases required by law, professional ethics, or your practice policies before entering information about a client, guardian, or collaborating professional into CareCompass. You are responsible for the content you enter, including its accuracy.
Obtaining client or guardian consent does not authorize a clinician to enter PHI or client-identifying information during the current beta. The beta prohibition applies regardless of consent.
5. What CareCompass is, and is not
CareCompass is a collaboration and organizational tool designed to help clinicians see the whole course of treatment. CareCompass does not replace clinical judgment, supervision, or professional responsibility. CareCompass is not marketed as, and should not be used as, a certified electronic health record system.
CareCompass is not an emergency or crisis service and does not monitor entries in real time. Entering information into CareCompass does not contact a clinician, crisis responder, emergency service, or law-enforcement agency.
- For mental-health crisis support in the United States, call or text 988 (Suicide and Crisis Lifeline).
- For immediate danger or a medical emergency, call 911. 988 is a crisis support line, not a substitute for emergency services when someone is in immediate danger.
6. No guaranteed outcomes
Treatment outcomes depend on many factors. CareCompass makes no guarantee that using the platform will produce any particular clinical result.
7. Intellectual property; your content
CareCompass and its software, design, and content (excluding your content) are owned by Mindful Me, LLC and its licensors and are protected by applicable law.
You retain ownership of the content you enter into CareCompass. You grant Mindful Me, LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, reproduce, and display your content solely as reasonably necessary to:
- provide the CareCompass services you request;
- perform AI-assisted features that you specifically invoke;
- maintain, operate, and secure the platform;
- prevent fraud, abuse, or misuse of the service;
- provide technical support you request;
- diagnose and troubleshoot errors; and
- comply with applicable law and legal process.
Mindful Me, LLC will not use your content to train a generalized AI model for unrelated customers or purposes without your separate, explicit authorization.
Please also note:
- Invoking an AI-assisted feature may transmit the submitted content to the AI provider identified in the Privacy Policy for processing on our behalf. We do not make representations about that provider’s retention or training practices beyond what is stated in the Privacy Policy.
- Protected health information (PHI) and client-identifying information remain prohibited during the current beta, including inside AI prompts.
- The feedback license in Section 8 applies to product suggestions and bug reports only, not to clinical or client-related content.
8. Feedback
If you submit product feedback, suggestions, or bug reports (including during beta), you grant Mindful Me, LLC a perpetual, royalty-free license to use that feedback to improve the service. This feedback license does not extend to clinical or client-related content. You are not required to submit feedback.
9. Beta status and service availability
CareCompass is currently in clinician beta. Features may change, be temporarily unavailable, or be removed without notice. We do not guarantee uninterrupted availability, perfect accuracy, or that the service will meet every requirement of your practice. See the HIPAA & Health-Data Notice for beta-specific data-entry rules.
10. Suspension and termination
Mindful Me, LLC may suspend or terminate your access if we reasonably believe you have violated these Terms, misused the service, entered prohibited content (such as PHI during beta), created safety risks, or otherwise harmed other users or the service. You may stop using CareCompass at any time and may request account deletion as described in the Privacy Policy.
11. Access and optional support
CareCompass access is currently free during early access. No purchase, subscription, or payment method is required to create an account or to use the product. You may optionally contribute financial support, on a one-time or monthly basis, as described in the Support & Cancellation Policy, which is incorporated into these Terms. Payments are processed by Stripe. Starting, changing, or cancelling optional support does not affect your CareCompass access, your data, or any optional Supporter recognition. Legacy paid subscriptions created under our retired paid model are also governed by that policy.
11a. CareCompass Supporter recognition
People who complete an optional contribution may choose to be listed publicly as a CareCompass Supporter. Recognition is opt-in, cosmetic, and reversible at any time. CareCompass Supporter recognition:
- becomes available only after a contribution is confirmed, with one-time and monthly contributions treated equally;
- never displays contribution amount, frequency, payment status, ranking, or any other financial detail;
- does not affect account approval, access, features, AI availability, permissions, or any other entitlement, and does not create employment, contractor, partnership, ownership, fiduciary, or corporate-board authority or any right to control product decisions;
- continues after monthly support ends, until the supporter opts out or we remove a listing that is inaccurate, misleading, or otherwise inappropriate; and
- does not grant any administrative or Owner role in CareCompass.
The Founding Clinician program has been retired. Historical records are retained for accounting and support purposes only and confer no current status, access, or benefit.
12. Privacy and data handling
Our Privacy Policy describes what information we collect, why, and how we protect it. Do not enter PHI or client-identifying information during the current beta.
13. HIPAA and BAA limitations
CareCompass is still completing its HIPAA-readiness work and is not a HIPAA-compliant service during the current beta. A CareCompass Business Associate Agreement (BAA) is not presently available. You may not enter PHI into CareCompass until we notify you that BAAs are operational and PHI use is authorized. See the HIPAA & Health-Data Notice for details.
14. Disclaimers
CareCompass is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Mindful Me, LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, error-free, or secure against every possible threat.
15. Limitation of liability
To the fullest extent permitted by law, Mindful Me, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the service, even if we have been advised of the possibility of such damages. The aggregate liability of Mindful Me, LLC for any claim arising out of or relating to CareCompass will not exceed the amount you paid Mindful Me, LLC in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow certain limitations, in which case the above applies to the maximum extent permitted.
16. Indemnification
You agree to defend and indemnify Mindful Me, LLC from any third-party claim arising from (a) your violation of these Terms, (b) content you enter into CareCompass in violation of applicable law or these Terms, or (c) your violation of any applicable professional or ethical obligation.
17. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules. You and Mindful Me, LLC agree that any dispute arising out of or relating to these Terms or CareCompass will be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
18. Changes to these Terms
Mindful Me, LLC may update these Terms from time to time. Updates are handled as follows:
- Minor or non-material changes (such as clarifying edits, contact-information updates, or administrative corrections) may become effective after we post the updated Terms and update the “Last updated” date; continued use after that notice constitutes acceptance of those non-material changes.
- Material changes: including changes to fees, subscription terms, data-handling practices, dispute resolution, liability, or the scope of the license to your content, will be presented to you for renewed acceptance when appropriate, and a new policy-bundle version must be accepted before a new paid Checkout Session can be created.
- Existing users will not be recorded as having accepted a policy version they never actually accepted. Server-side policy-acceptance records remain the authoritative source of which version each user has accepted, and enforcement of these Terms depends on that server-side record.
